Terms of Service

Welcome to RemitDLT. These Terms of Service ("Terms") govern your use of the RemitDLT platform operated by StackStats Apps LLC ("we," "our," "us"). By using RemitDLT, you agree to these Terms. If you don't agree, please don't use the service.

Important: Blockchain transactions are irreversible. Once a transfer is confirmed on the XRP Ledger, it cannot be undone. Double-check all recipient addresses before sending.

1. Acceptance of Terms

By creating an account, accessing our website, or using RemitDLT services, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. You must be at least 18 years old and legally capable of entering into binding contracts.

2. Service Description

RemitDLT is a cross-border remittance platform that facilitates stablecoin transfers on the XRP Ledger. We provide:

  • Facilitation of XRPL stablecoin transfers (RLUSD, USDC)
  • User interface for sending and receiving payments
  • Transaction history and verification
  • Customer support

We are NOT: A bank, money transmitter (where not required), or custodial wallet service. You maintain control of your funds and private keys (for non-custodial accounts).

3. Account Registration

3.1 Account Creation

To use RemitDLT, you must:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be solely responsible for all activity under your account

3.2 Verification Requirements

Depending on transaction volume and jurisdiction, we may require identity verification (KYC) to comply with anti-money laundering (AML) regulations. Failure to provide required documentation may result in account limitations.

4. Fees and Pricing

4.1 Transaction Fees

  • Pay-As-You-Go: $0.99 per transfer (any amount, any corridor)
  • Pro Plan: $9.99/month for unlimited transfers
  • Business Plan: $29/month for business features

4.2 XRPL Network Fees

XRPL network fees (typically 0.00001 XRP) are paid by the sender and are separate from RemitDLT service fees. These go to XRPL validators, not RemitDLT.

4.3 Fee Changes

We reserve the right to change fees with 30 days' notice. Continued use after notice constitutes acceptance of new fees.

5. Use of Service

5.1 Permitted Use

You may use RemitDLT for lawful cross-border remittance, including:

  • Personal remittances to family/friends
  • Payment for goods and services
  • Business payments to suppliers/contractors
  • Charitable donations

5.2 Prohibited Use

You may NOT use RemitDLT for:

  • Money laundering or terrorist financing
  • Fraud, scams, or deceptive practices
  • Purchase of illegal goods or services
  • Violation of sanctions or export controls
  • Gambling or gaming (where prohibited)
  • Any activity violating local, state, or federal law

We reserve the right to suspend or terminate accounts engaged in prohibited activities and report to authorities as required.

6. Blockchain Transactions

6.1 Irreversibility

Warning: Blockchain transactions are IRREVERSIBLE. Once confirmed on the XRP Ledger, transfers cannot be canceled, reversed, or refunded. Always verify recipient addresses before sending.

6.2 Network Delays

While XRPL typically settles in 3-5 seconds, network congestion or technical issues may cause delays. RemitDLT is not responsible for blockchain network performance.

6.3 Public Ledger

All transactions are recorded on the public XRP Ledger. Anyone can view wallet addresses, amounts, and timestamps. This is fundamental to blockchain transparency and cannot be made private.

7. Wallet and Key Management

7.1 Non-Custodial Accounts

For non-custodial accounts, YOU are responsible for securing your wallet private keys. If you lose your keys, we CANNOT recover your funds. RemitDLT does not have access to your private keys.

7.2 Custodial Accounts (Optional)

For custodial convenience accounts, we secure keys on your behalf. You trust us to maintain security, but you retain ownership. We implement industry-standard security measures but cannot guarantee absolute protection.

8. Limitations of Liability

8.1 Service Availability

RemitDLT is provided "AS IS" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure service. We may suspend service for maintenance, updates, or technical issues.

8.2 Maximum Liability

To the maximum extent permitted by law, our total liability for any claim is limited to the greater of: (a) $100, or (b) the fees you paid RemitDLT in the past 6 months.

8.3 No Liability For:

  • Blockchain network failures or delays
  • Loss of private keys
  • Incorrect recipient addresses
  • Exchange rate fluctuations
  • Third-party service failures (XRPL nodes, stablecoin issuers)
  • Acts of God, war, terrorism, or government action

9. Indemnification

You agree to indemnify and hold harmless StackStats Apps LLC, its officers, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from: (a) your use of RemitDLT, (b) violation of these Terms, (c) violation of any law or third-party rights, or (d) negligence or misconduct.

10. Termination

10.1 By You

You may close your account at any time by contacting support. You are responsible for withdrawing any remaining funds before closure.

10.2 By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • We suspect fraudulent or illegal activity
  • Required by law or regulatory authority
  • You fail identity verification
  • Service is discontinued

We will provide notice where legally permitted and assist with fund withdrawal (if not frozen by authorities).

11. Dispute Resolution

11.1 Informal Resolution

Before filing any legal claim, you agree to contact us at [email protected] to attempt informal resolution. We'll work in good faith to resolve disputes.

11.2 Arbitration (US Users)

For US users: Any dispute not resolved informally will be settled by binding arbitration under the American Arbitration Association (AAA) rules, rather than in court. You waive the right to a jury trial or class action. Arbitration is on an individual basis only.

11.3 Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

12. Compliance and Reporting

12.1 AML/KYC

We comply with applicable anti-money laundering (AML) and know-your-customer (KYC) regulations. We may request identity documents, transaction details, or source of funds information.

12.2 Suspicious Activity

We are required to report suspicious transactions to FinCEN (Financial Crimes Enforcement Network) and other regulatory authorities. You agree we may freeze accounts and report activity without prior notice.

12.3 Tax Reporting

You are responsible for reporting and paying all applicable taxes on your transactions. We may provide tax forms (e.g., 1099-K) as required by law.

13. Intellectual Property

All RemitDLT content, trademarks, logos, and intellectual property are owned by StackStats Apps LLC. You may not copy, reproduce, or distribute our materials without written permission.

14. Privacy

Your use of RemitDLT is subject to our Privacy Policy, which explains how we collect, use, and protect your data. Please review it carefully.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be announced via email or website notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. Invalid provisions will be replaced with valid ones that most closely reflect the original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RemitDLT. They supersede any prior agreements or understandings.
